  1. Privacy Policy of the Campaign
    • HAWLEY & HAZEL MARKETING (MALAYSIA) SDN BHD and ITTIFY SDN BHD (collectively referred to as “we” or “us ”, and respectively referred to as “Hawley&Hazel” or “Ittify”) respect personal data and are committed to full implementation and compliance with the data protection principles and all relevant laws in Malaysia.
    • This Policy is applicable to all the participants of【Darlie: The Next Creator campaign】 (“Campaign”) whose personal data is collected, by whatever means, used and held by Hawley & Hazel.
    • You agree to the Privacy Policy of the Campaign and the Privacy Policy of Hawley & Hazel before participating to the Campaign. Please see Hawley & Hazel’s privacy policy in the official website (https://www.darlie.com.my/en/corporate-info/privacy).

  2. Kinds of Personal Data Collected, Used and Held
    • Participants are required to provide their personal data, including full name (as per NRIC), NRIC Number/ Malaysia PR Number, Handphone Number, E-mail address, Residential Address, Active Social Media Accounts, Facebook Account Name/Tiktok Account Name (if any), Personal Instagram Account name, age to Hawley & Hazel and/or its designated partner.
    • You may provide Organizers with your personal data at your own will. The personal data mentioned in paragraphs i) is mandatory. Your participation will not be considered if you fail to provide the said mandatory data.

  3. Purposes of the Personal Data is Held
    • We will use your personal data for the following purposes:
      1. verification of your identity;
      2. Notify you if you are the selected participant;
      3. executing the Campaign arrangements;
      4. promotional, marketing and/or administrative purposes;
      5. Statistics and Retargeting: carry out anonymous statistics and data analysis and show you relevant advertisements more often when you visit other websites;
      6. Other purposes as required by law, including without limitation to court proceedings, criminal investigations or prosecutions or where so ordered by any competent authority;
    • Participants agree and grant Hawley & Hazel (including any Third Party which authorized by Hawley & Hazel) to post the Campaign and its photos and videos (including but not limited to their likeness, voice, individual images and personal data) on the social media platform for the Campaign promotional purposes without further payment or compensation.
      1. If the above materials involve the portrait and other personal information of the other person, the participant guarantees that he/she has legally obtained the authorization from that person.

  4. Transfer of Personal Data to Third Parties
    By participating the Campaign, you hereby agree that Hawley & Hazel may transfer your personal data to third party to execute the purposes set out in paragraph 3 hereinabove without any further notice.

  5. Retention of Personal Data
    • Hawley & Hazel will retain all your personal data for so long as is necessary for the fulfillment of the purpose(s) for which they were collected and of the legal requirements.

    • Your information and data are stored and maintained in【the electronic database, facilities, servers and back-up servers of Hawley & Hazel and Ittify】which may be located outside your country, where the legal protection and standard of security requirements may not be equivalent to the same provided by and legally required by the applicable laws and regulations of your country. You hereby expressly consent on Hawley & Hazel’s transferring, storing, maintain and retaining all your information and data in our designated electronic databases, facilitates, servers and back-up servers located outside your country for the purposes referred to in Clause 3.

  6. Accuracy and Change of Personal Data
    In order to ensure the correctness of the participants’ personal data, particularly contact details retained by us, you may receive our request of confirmation or verification. Please feel free to contact us for correction or change of personal data or opt-out from receiving future direct promotional and marketing information.

  7. Personal Data Handling and Security Measures
    • Apart from statutory requirements and/or the purposes stated hereinabove, the personal data we collected about you will not be transferred or disclosed to any other party without your prior approval.
    • We have established in place security measures and monitoring procedures to prevent unauthorized or accidental access, processing, erasure, loss or use of the data. All personnel that may access to the data will be ensured complying with the requirements of data protection.

  8. Limitation of Liability
    We have implemented all reasonably practicable procedures, measures and steps to safeguard the security of your personal data. However, no method of transmission over the Internet, or method of electronic storage, is totally secure. We cannot guarantee its absolute security.

  9. Changes in this Privacy Policy
    • We may update or amend this Privacy Policy in the future, if necessary. The revised Policy will be available at this website.
    • If any provision of this Privacy Policy is found to be invalid or unenforceable, then such invalidity or unenforceability shall not affect the other provisions of this Privacy Policy which shall remain in full force and effect
