Darlie Malaysia x Demon Slayer - Instagram Giveaway - Terms and Conditions

Please read these Terms and Conditions carefully before participating in the Darlie Malaysia (@darliemy) Instagram Giveaway organized by Hawley & Hazel Marketing (Malaysia) Sdn. Bhd. (Registration No. 198301010293 (105656-T)) [“Organizer“]. By entering the giveaway, you shall be deemed to have accepted, agree to be bound by these Terms and Conditions and all decisions made by the Organizer, which are final and binding in all respects.

• Eligibility:
  • The giveaway is open to all Malaysia residents who are at least 18 years old at the time of entry.
  • Participants must have a valid and active Instagram account.
  • Participants must be a Malaysian citizen with a valid MyKad.
• Individuals from the following groups are not eligible to participate in this Contest:
  • Employees of the Organizer [including associated and related companies] and their immediate family members [children, parents, siblings, including spouses]; and/ or
  • The Representative, staff, employees and / or agents of the advertising and / or promotion services of the Organizer [including its affiliated and related companies], and their immediate family members [children, parents, siblings, including spouses].
  • Individuals who have a direct relationship with the staff of the Organizer [including associates and related companies]
• Entry Period:
  • The giveaway entry period will be specified in the giveaway post on Darlie's Official Instagram page.
• How to Enter:
  • To participate, you must follow the entry instructions provided in the giveaway post.
  • Only one entry per Instagram account is allowed during the entry period.
• Winner Selection and Notification:
  • The winner will be selected randomly from all eligible entries received during the entry period.
  • Selected winners will be informed via private message on Instagram.
  • The winner will be contacted via direct message on Instagram. If the winner does not respond within the given date, a new winner may be selected.
  • The winner must be a first-time winner, no repeated winners will be chosen.
• Prize:
  • The prize for the giveaway will be detailed in the giveaway post unless mentioned mystery gift.
  • Prizes will be awarded in random designs, and winners are not entitled to select a specific design; once delivered, the prize is deemed final and non-exchangeable.
  • The prize is non-transferable and cannot be exchanged for cash or any other item.
  • The Organizer reserves the right to substitute the prize with a similar one of equal or greater value in the event of unforeseen circumstances.
• Shipping and Delivery:
  • The Organizer will be responsible for shipping and delivery of the prize to the winner's address. However, the Organizer is not responsible for any lost, stolen, or damaged items during transit.
• Publicity Release:
  • By participating in the giveaway, the winner agrees to allow the Organizer to use their name, Instagram handle, likeness, and/or comments for promotional purposes without further compensation or notice.
• Prohibited Content:
  • Entries containing offensive, defamatory, or inappropriate content will be disqualified.
  • Participants must not use any fraudulent or deceptive means to enter or increase their chances of winning.
• Compliance with Instagram Rules:
  • This giveaway is in no way sponsored, endorsed, or administered by, or associated with, Instagram. Participants release Instagram from any responsibility related to the giveaway.
  • Participants must fulfill the criteria that is mentioned on the Instagram post.
• Changes and Termination:
  • The Organizer reserves the right to modify, suspend, or terminate the giveaway at any time without prior notice and for any reason.
• Governing Law:
  • These Terms and Conditions shall be governed by and construed in accordance with the laws of Malaysia without regard to its conflict of law principles.

Notice under Section 7 of the Personal Data Protection Act 2010 (“PDPA”) to consumers of Hawley & Hazel Marketing (M) Sdn. Bhd.

Dear Consumers,

3. Individual has the right to access and correct your personal data once given;
4. Individual’s personal data is disclosed to an elected Agency / Organizer for processing;
5. The personal data requested from individual will only be used for the purpose as stipulated;
6. The personal data given is obligatory and all incomplete entries will render the participation void;
7. Individual’s personal data will be validated upon confirming winners and if there are changes to the personal data, the individual is required to update the Organizer.
8. Transfer of Personal Data to Third Parties
• By participating the Contest, you hereby agree that the Organizer may transfer your personal data to third party and the Organizer’s affiliates, among which of such third party and/ or our affiliates may be located outside your country, to execute the purposes set out in this Terms and Conditions hereinabove without any further notice.
• Your information and personal data are stored and maintained in [the electronic database, facilities, servers and back-up servers of the Organizer, its affiliates, and/or the third party authorized by the Organizer] which may be located outside your country, where the legal protection and standard of security requirements may not be equivalent to the same provided by and legally required by the applicable laws and regulations of your country. You hereby expressly consent on the Organizer’s transferring, storing, maintain and retaining all your information and data in our designated electronic databases, facilitates, servers and back-up servers located outside your country for the purposes referred to in this T&C.
